By accessing and using QueryCatch (the "Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, you may not use the Service.

QueryCatch is a self-service SEO platform that provides AI-powered tools for meta optimization, image optimization, SEO audits, and analytics integration with platforms including WordPress, Shopify, Google Search Console, Google Analytics, and Kinsta.

These Terms constitute a legally binding agreement between you and QueryCatch. By creating an account, making a purchase, or using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms.

QueryCatch provides a comprehensive self-service SEO platform with the following features:

• AI-powered meta title and description optimization tools

• Image alt text optimization for WordPress media libraries

• Comprehensive SEO audits combining content analysis and technical assessment

• QueryCatch IQ for keyword research and search intelligence

• Integration with Google Search Console, Google Analytics, WordPress, Shopify, and Kinsta

• Team management and multi-profile support

• Analytics dashboards and reporting tools

• Documentation and support resources

The Service is provided on a subscription basis with monthly billing. All features are included in the base plan with additional charges for extra websites and users.

You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you are at least 18 years of age.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

You may not create multiple accounts to circumvent restrictions or obtain additional trial periods.

The Service is offered on a subscription basis with the following pricing structure:

• Base Plan: $99 USD per month (includes 1 website, 2 users, all 20+ features)

• Additional websites: $39 USD per month each

• Additional users: $19 USD per month each (per website)

• Volume discounts available for 6+ websites (10% off), 21+ websites (30% off), 51+ websites (40% off), 100+ websites (40% off)

All prices shown are in US Dollars (USD) and include local tax where applicable.

For Australian customers, GST is included in the stated prices. Tax invoices will be provided for all payments.

For international customers, prices remain the same but may be subject to local taxes or VAT in your jurisdiction.

Billing occurs monthly in advance. Your subscription will automatically renew each month unless cancelled.

We accept major credit cards and other payment methods as displayed during checkout. By providing payment information, you authorize us to charge the applicable fees to your chosen payment method.

Due to API usage rates and token usage, a free trial is not available.

If payment for your subscription fails, we will attempt to process payment multiple times over a 14-day period.

You will receive notifications about failed payments via email to the address associated with your account.

If payment cannot be successfully processed within 14 days of the original billing date, your Service access will be suspended.

During suspension, you will not be able to access the Service features, but your data will be retained for 30 days to allow for account recovery.

Once payment is successfully processed, your Service access will be immediately restored.

If your account remains suspended for more than 30 days due to payment failure, we reserve the right to permanently delete your account and associated data.

You may cancel your subscription at any time through your account settings or by contacting support at legal@querycatch.com.

Cancellations take effect at the end of your current billing period. You will continue to have access to the Service until the end of the period you have paid for.

No partial refunds are provided for unused portions of subscription periods. All sales are final.

Upon cancellation, your data will be retained for 30 days to allow for potential account reactivation. After 30 days, all data associated with your account will be permanently deleted.

Refunds may only be provided at our sole discretion in cases of technical issues that prevent Service usage for extended periods.

We take data security seriously and implement industry-standard security measures to protect your information.

Our data processing practices are governed by our Privacy Policy, which is incorporated into these Terms by reference.

You retain ownership of all data you input into the Service. We do not claim ownership of your content, websites, or SEO data.

We may process your data to provide the Service, including integration with third-party platforms like Google Search Console, Google Analytics, WordPress, Shopify, and Kinsta.

You are responsible for ensuring you have appropriate rights and permissions for any data you provide to the Service.

We comply with applicable data protection laws including GDPR, CCPA, and Australian Privacy Principles.

You agree not to use the Service for any unlawful purpose or in any way that could harm QueryCatch or other users.

Prohibited activities include but are not limited to:

• Using the Service to engage in fraudulent or deceptive practices

• Attempting to gain unauthorized access to other users' accounts or data

• Using automated tools to scrape or extract data from the Service beyond normal usage

• Reverse engineering, decompiling, or attempting to extract source code from the Service

• Using the Service to spam, harass, or send unsolicited communications

• Violating any applicable laws or regulations

We reserve the right to suspend or terminate accounts that violate this Acceptable Use Policy.

The Service integrates with various third-party platforms including Google Search Console, Google Analytics, WordPress, Shopify, and Kinsta.

These integrations are subject to the terms and conditions of the respective third-party providers.

We are not responsible for the availability, functionality, or changes to third-party services that may affect our integrations.

You are responsible for maintaining valid accounts and appropriate permissions with third-party services.

We may discontinue or modify integrations based on changes to third-party APIs or business requirements.

QueryCatch and all related trademarks, service marks, logos, and intellectual property are owned by QueryCatch or our licensors.

The Service, including all AI-powered tools, software, documentation, and content, is protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to use the Service solely for your business purposes in accordance with these Terms.

You may not copy, modify, distribute, sell, or create derivative works of any part of the Service without our express written permission.

All feedback, suggestions, or ideas you provide about the Service become our property and may be used without compensation or attribution.

WE DO NOT GUARANTEE THAT:

• The Service will be uninterrupted, error-free, or completely secure

• The Service will meet your specific requirements or expectations

• SEO improvements or ranking increases will result from using the Service

• Third-party integrations will always function perfectly or remain available

• AI-generated recommendations will always be accurate or optimal

• The Service will be compatible with all websites, platforms, or configurations

NO GUARANTEE OF RESULTS: While our tools are designed to help optimize SEO, we make no guarantees about search engine rankings, traffic increases, or business outcomes. SEO results depend on many factors beyond our control, including search engine algorithms, competition, and content quality.

TECHNICAL LIMITATIONS: The Service may have technical limitations, temporary outages, or compatibility issues with certain platforms or configurations. We strive to minimize such issues but cannot guarantee perfect performance at all times.

This limitation of liability applies regardless of the theory of liability, whether based in contract, tort, negligence, strict liability, or otherwise.

You agree to indemnify, defend, and hold harmless QueryCatch, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, costs, or expenses (including reasonable attorney fees) arising from:

• Your use of the Service in violation of these Terms

• Your violation of any applicable laws or regulations

• Your violation of any third-party rights, including intellectual property rights

• Any content or data you provide to or through the Service

This indemnification obligation survives termination of these Terms.

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time with or without notice.

We may update these Terms from time to time. When we make material changes, we will notify you by email or through the Service.

Your continued use of the Service after any changes to these Terms constitutes acceptance of those changes.

If you do not agree to the modified Terms, you must stop using the Service and may cancel your subscription.

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms.

Upon termination, your right to use the Service ceases immediately, and your data will be deleted in accordance with our data retention policies.

Sections relating to intellectual property, disclaimers, limitation of liability, indemnification, and governing law shall survive termination of these Terms.

These Terms are governed by and construed in accordance with the laws of Australia, without regard to conflict of law principles.

For users in the United States, any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the American Arbitration Association's rules.

For users outside the United States, any disputes shall be subject to the exclusive jurisdiction of the courts of Australia.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

The Service is operated from Australia and is intended for use by individuals and businesses worldwide.

Users are responsible for complying with all applicable local laws and regulations in their jurisdiction.

We make no representation that the Service is appropriate or available for use in all countries or jurisdictions.

If you access the Service from outside Australia, you do so at your own risk and are responsible for compliance with local laws.

Export control laws may apply to the Service. You agree to comply with all applicable export control laws and regulations.

QueryCatch shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, labor disputes, or government actions.

This includes disruptions to third-party services that our integrations depend upon, such as Google APIs, hosting providers, or internet infrastructure.

In the event of force majeure, we will make reasonable efforts to restore Service as quickly as possible.

These Terms, together with our Privacy Policy and any other legal notices published by us on the Service, constitute the entire agreement between you and QueryCatch.

These Terms supersede all prior or contemporaneous understandings or agreements, whether written or oral, regarding the Service.

No waiver of any provision of these Terms shall be deemed a further or continuing waiver of such provision or any other provision.
